PATENTUS lawyers have contested RUPTOs decision on the trademark BULAVA in the Intellectual Property Court

In the October of 2017 INTERTOOLMASH, LLC filed an objection against granting of the legal protection to the trademark BULAVA (certificate 600131 issued in the Russian Federation) to Patent Dispute Chamber. ABSGROUP,LLC is a right holder of this trademark.

Arguments of the objection were that trademark was confusingly similar to the registered trademark BULAVA  (certificate 582751) in relations to 7 and 8 classes of Nice Classification. The last one has been registered in the name of INTERTOOLMASH, LLC.

In the April of 2018 the board of Patent Dispute Chamber sustained an objection and invalidated granting of the legal protection to the trademark BULAVA (certificate 600131).

Managing partner Dmitry Markanov and associate Tatiana Savinykh represented ABSGROUP,LLC and contested RUPTOs decision in the Intellectual Property Court.

PATENTUS lawyers proved that trademarks have not been confusingly similar in relations to goods from 7 and 8 classes of Nice Classification.

On the 4th  of December 2018 . Intellectual Property Court held to satisfy a motion of ABSGROUP,LLC, invalidate decision of RUPTO from 28.04.2018. The Court recognized the decision was inappropriate to para 6 article 1483 of the Civil Code of Russian Federation. The Court also compelled RUPTO reconsider an objection of INTERTOOLMASH, LLC.
