PATENTUS lawyers reached a settlement agreement in favour of the manufacturer of muesli-bars EGO

Our client, the company I.D.C. Holding, is the owner of international trademark No. 773792 ALTER EGO registered in respect of the goods in class 30 under the Nice Classification. In June 2014 I.D.C. Holding filed a word & device trademark application No. 2014720916 EGO for the goods in class 30 under the Nice Classification.

In March 2015, in order to overcome the obstacles to the registration of its trademark EGO, IDC Holding appealed to the Court for Intellectual Property Rights to claim for early termination of legal protection for trademark No. 226237 Ego Holding based on its non-use in respect of the goods in Class 29 (meat, fish, poultry and game ...) and Class 30 (coffee, tea, cocoa, sugar, rice ... ) of the Nice Classification.

On July 28, 2015 the Court of Intellectual Property Rights approved an amicable agreement on the division of the areas of interests between the IDC Holding and Holding Company EGO-Holding (case No. SIP-120/2015).

According to the amicable agreement the companies divided the areas of intrests as follows: Holding Company" EGO-Holding preserved the right to use the designation EGO in Latin and Cyrillic for such goods as meat, fish, poultry and game; meat extracts, whereas IDC Holding acquired the right to freely use the designation EGO in Latin and Cyrillic for a wide range of confectionery products.
