Patent attorneys of PATENTUS LLC succeeded in the proceedings for the invalidation of a patent blocking sales of bulbs Uniel in Russia

The company Uniel, a client of PATENTUS LLC, is known in Russia as a manufacturer and importer of lighting products.

In 2013 the company Uniel faced with the claims laid by its longtime rival OOO Kompleksnye postavki, the legal owner of the patent for utility model No. 91472.

As part of the claim, OOO Kompleksnye postavki required to stop selling bulbs, which, in its opinion, infringed the right to the patent. Accordingly, OOO Kompleksnye postavki applied to the bodies of internal affairs and sent letters demanding to remove the products from sale in the trade networks Auchan and Leroy Merlin.

To protect the clients interests the patent attorneys of PATENTUS LLC prepared and filed an objection to invalidate the Russian patent for utility model No. 91472 to the Patent Disputes Chamber.

On February 20, 2014 following the consideration of the objection the Patent Disputes Chamber decided to grant the objection. Patent for utility model No. 91472 was hold fully invalidated. Thus, the patent attorneys of PATENTUS LLC protected the interests of the client, and the products sales in the Russian retail chains were resumed.

The objection for the patent invalidation was prepared by Alexey Mikhailov, the Head of Patent Practice in PATENTUS LLC, Patent Attorney of the Russian Frderation, Eurasian Patent Attorney.

Judicial support in a parallel process was provided by Markanov Dmitry, the Head of Litigation Department, Patent Attorney.
