Rival companies “Kholod Slavmo” and “Khladokombinat No. 1” (refrigerating plant) entered into a settlement agreement

Since 2003 there have been legal proceedings between the manufacturers of ice cream “Kholod Slavmo” and “Khladokombinat No. 1” related to the rights to use the design of packaging for ice cream “Sugar roll”.

In 2011 the lawyers of PATENTUS began to represent the interests of “Kholod Slavmo”. They won a number of cases (No. A56-69702/2011, No. A56-9300/2012) and a variety of litigation cases are still pending in the courts of arbitration.

At the end of 2014 the management teams of “Kholod Slavmo” and “Khladokombinat No. 1” came to a conclusion on the settlement of all disputes by peaceful means. The parties entered into a corresponding master agreement, and it was agreed to stop all pending litigation cases.

So, with the support of PATENTUS lawyers, it was agreed to sign an amicable agreement in respect of case No. A76-22720/2013. In accordance with its terms, “Khladokombinat No. 1” undertook to check the production of ice cream in the disputed packaging and to withdraw the ice cream in the disputed packaging from circulation by May 1, 2015. The parties committed themselves to use the ice cream packaging design in a way that would not violate the rights of either party.

On February 19, 2015 the Court for Intellectual Property Rights considered and formally approved the amicable agreement between the parties in respect of case No. A76-22720/2013.

Thus, the dispute, which lasted more than 10 years, can be considered brought to a close.
