PATENTUS managed to safeguard the interests of ASPECT bank at the Chamber of Patent Disputes

In the summer of 2013 the banking corporation ASPECT applied to Rospatent for the registration of their logo ASPECT as a trademark for the services in class 36 under the Nice Classification.

A year later Rospatent notified the bank of the impossibility of registering the trademark because it was confusingly similar to the registered trademark aspect (No. 521394) for the services in class 36 under the Nice Classification.

In the Chamber of Patent Disputes Patentus lawyer Tatiana Sergunina was able to prove that the widespread use of the designation Aspect by the bank prior to the priority date of the cited trademark as well as the presence of early company name used in the provision of similar services in class 36 under the Nice Classification and the existence of a similar earlier trademark registered for the services of similar class 36 under the Nice Classification (trademark No. 124204) confirmed the illegality of the cited trademark registration according to the several points of law.

The Board of the Chamber for Patent Disputes decided to annul the trademark aspect (No. 521394) in respect of all services in class 36 under the Nice Classification, which will allow our client to smoothly register their trademark.
