Registration for the round table on "Perspectives of matching of foreign companies rights to intellectual property with the interests of Russian consumers" has opened

Today the registration for the round table on "Perspectives of matching of foreign companies rights to intellectual property with the interests of Russian consumers" (parallel imports and compulsory licensing the pros and cons) has opened. The round table is being held by the Chamber of Commerce and Industry of the Russian Federation involving our company within the framework of the Ninth International Forum "Intellectual Property 21st century".

On April 25, 2016 the Chamber of Commerce and Industry of the Russian Federation will be hosting participants of the business round table "Perspectives of matching of foreign companies rights to intellectual property with the interests of Russian consumers".

The round table will discuss the most pressing issues for the moment related to the intellectual property in Russia.

The main areas of discussion will be as follows:

Prospects for the legalization of parallel imports: the pros and cons.

Compulsory licensing of patented inventions an urgent need, or the violation of the holders rights.

You can take part in the discussion and put questions to the representatives of the Federal Antimonopoly Service (FAS), Rospatent, Customs Service, Russian and international law firms as well as take an opinion about possible changes in the legislation from representatives of major international and Russian companies-IP owners.

Program:

1. Parallel imports legalization prospects: the pros and cons

As you know, the Russian Federation has a national principle of exhaustion, however, recently the question of cutting over to the international principle of exhaustion in respect of certain categories of goods has been discussed the most actively which gives reasons to believe that in the near future parallel imports may be partially or completely legalized.

The advantages and disadvantages of such legalization, measures to control parallel imports at the moment as well as the relevant case-law will be in the first place of the discussion.

2. Is compulsory licensing for patented inventions an urgent need or the violation of holders rights?

The FAS of the RF has proposed amendments to the Civil Code of the Russian Federation according to which in certain cases the courts may oblige a patent owner to grant a license to use the invention.

The representatives of the FAS, Rospatent, as well as leading lawyers and representatives of Russian and foreign IP holders will disclose their ideas on the conformity of the proposed law with the accepted norms of international law and international practice as well as some positive and negative effects of the potential innovations.

The results of the round table will be included in the Resolution of the forum, and all the proposals will be forwarded to the President of the Chamber of Commerce and Industry of the RF and will form the basis for the elaboration of the State Intellectual Property Development Strategy.
