Denis Kudryavtsev shared with Kommersant his opinion on how foreign IP owners who have left Russia protect their IP rights

Big foreign companies such as LEGO, Nike, Entertainment One UK Limited (owner of Peppa Pig trademarks and works) and Carte Blanche Greetings Limited (owner of Teddy Bear trademarks and works) are actively protecting their intellectual property rights. Legal proceedings over IP infringements are frequent, which emphasizes a need for more efficient protection mechanisms and sever punishment measures against infringers.

When speaking on how foreign owners of intellectual property who have left the Russian market protect their IP rights, Denis Kudryavtsev notes that foreign IP owners protect their IP rights in different ways. Some of them use the administrative procedure for imposition of liability on infringers under Article 14.10 of the RF Code of Administrative Procedure, while others rely on the provisions of civil law to claim compensation for infringement of IP rights under Article 1301 (author’s rights) and Article 1515 (trademarks) of the RF Civil Code. Most frequent compensation claims are for infringement of exclusive rights to trademarks (famous clothing brands) and copyrighted items (cartoon character images, cartoon characters embodied in such goods as toys, construction kits, videogames, etc).

Denis Kudryavtsev also dwelled on the reasons for leaving Russia by foreign businesses, what effect this had on protection of their IP rights, what changes occurred after legalization of parallel import in Russia and other relevant aspects.
