In 2022 Anton Pinskiy, a famous Russian restaurant keeper, wished to launch his restaurant at the Patriarch’s Ponds area in the center of Moscow. His application for registration of the "Patriki Café” trademark was refused due to a third party’s previous trademark registration “Patriki”.

Pinskiy asked PATENTUS for legal assistance. Denis Kudryavtsev, lawyer at PATENTUS, advised the client. Denis discovered that the owner of the cited trademark had been dissolved and liquidated. So he collected all necessary documents for bringing a non-use cancellation action against the “Patriki” trademark to the IP court (matter ID SIP-663/2023).

Thanks to Denis’s efforts, the client obtained a favorable decision from the Russian PTO and registration of his trademark “Patriki Café”.

The outcome of the proceedings is illustrative, as it shows that one is able to protect its interests and overcome obstacles to trademark registration or use with the help of competent lawyers and sound arguments developed by them.
