Owner of “I am pajama” trademark asserted its IP rights

Protection of intellectual property rights is critical to businesses these days. Of special importance is protection of trademarks as they are fundamental to successful operation of a business. A client of PATENTUS, being the owner of the “I am pijama” trademark » was facing a problem when its competitor started using a confusingly similar trademark. As the client was using the trademark design version which drastically differed from the design of the registered trademark, the probability of cancelation of the trademark registration for some goods was high.

Both parties could go to court for leverage. The PATENTUS lawyers proposed making a settlement agreement. The negotiations resulted in that the competitor agreed to stop using the similar mark and the client’s trademark registration was secured.
