Fortek LLC manufactures sporting goods and accessories under the FORTEK brand. In order to register its trademark it filed an application to Rospatent. In response, the examination of Rospatent indicated an obstacle to registration - the registered trademark "FORTEX" No. 578404, belonging to a foreign company.
PATENTUS lawyer Maria Meshcheriakova, on behalf of her client, filed a lawsuit in the Intellectual Property Court to invalidate the interfering trademark on the grounds of non-use.
In the beginning of March 2021, the Intellectual Property Court ruled to terminate the legal protection of the trademark "FORTEX" due to its non-use under Classes 25 and 28 of the Nice Classification.
