The cession mechanism has recently begun to be considered by the courts as a way to circumvent the Presidential Decree on Settlements through Type “O” Accounts.
The issue of transferring funds to the claimant’s representatives was already raised during one of the cases on Rovio lawsuit in 2023, recalled Denis Kudryavtsev, Dispute Resolution Lawyer at Patentus:
“In that case, the Supreme Court decided that the money should be transferred only to the claimant to an account opened in a Russian bank.” In current practice, the courts will most likely be guided by the position of the Intellectual Property Court: “If the court’s decision is not appealed in the Supreme Court, the practice of further refusals may continue.”
